This page outlines the terms and conditions that apply to all services provided by Elegance Upholstery. Whether you're considering working with us or are a returning customer, we encourage you to review these terms to understand our policies on estimates, deposits, cancellations, warranties, and project timelines. These terms are designed to ensure transparency and protect both our clients and our business.
Terms of Service

1. Fabric & Materials Policy
1.1. Any leftover fabric under 5 yards is considered surplus and becomes the Client's property upon project completion. This fabric will not be refunded. If the Client chooses not to take it at pickup, it becomes the property of Elegance Upholstery and may not be claimed later.
1.2. In the event of a measuring or ordering discrepancy resulting in 5 or more yards of unused fabric, the Client will receive a credit for the full value of the unused amount. The Client may also choose to purchase the remaining fabric to take home.
1.3. A materials deposit is required before any fabric, foam, or related supplies are ordered. No work will begin until this deposit is received.

2. Deconstruction & Patterning
2.1. All existing upholstery will be removed and deconstructed to create new patterns and prepare for reupholstery. Elegance Upholstery does not apply new upholstery over old coverings under any circumstances.
2.2. If the Client wishes to retain the original upholstery material, they must indicate so.

3. Design & Aesthetic Preferences
3.1. All design decisions not expressly communicated before the upholstery process begins will be made at the discretion of the upholsterer, including but not limited to:

-
Piping vs. topstitching
-
Pattern alignment
-
Material types and treatments
3.2. Elegance Upholstery will not re-do work based on uncommunicated aesthetic preferences. We will re-do work that is materially defective or does not meet our own internal quality standards.
3.3. The upholsterer's judgment and standard of quality are final unless an agreed-upon specification is explicitly documented in advance.

4. Quality Standards & Professional Judgment
4.1. Elegance Upholstery is a high-end, high-quality shop. All work is performed to a standard intended to maximize durability, function, and appearance.
4.2. The Client understands and agrees that the upholsterer may use their professional judgment to replace or repair internal or structural elements (e.g., springs, foam, supports) as necessary to ensure long-lasting results. This may involve additional costs.
4.3. If the Client declines recommended structural or frame repairs, Elegance Upholstery is not liable for any instability, failure, or premature wear that results from the Client’s refusal. The Client assumes full responsibility for the integrity and performance of the item if repairs are not authorized.
4.4. While every effort will be made to communicate material cost changes during the project, the Client agrees that not all decisions require prior approval if they are deemed necessary for the quality and safety of the finished product.

5. Payments & Deposits
5.1. A non-refundable materials deposit is required before any materials are ordered or work is started.
5.2. The final balance must be paid in full before the piece is released to the Client. No exceptions will be made unless a prior written agreement is made by the owner.
5.3. Accepted forms of payment: cash, check, e-transfer, debit, credit card (subject to processing fees), or approved financing.
5.4. The Client agrees that payment in full for the completed project constitutes acceptance and satisfaction with the work performed, and waives further claims related to subjective quality or aesthetic preferences not previously documented.

6. Cancellations, Refunds & Abandonment
6.1. Orders cancelled after materials have been ordered will not be refunded. The Client may request that unused materials be returned to them.
6.2. Projects not picked up within 14 days of completion notice will incur a $10/day storage fee unless alternative arrangements have been approved.
6.3. Projects left unclaimed after 60 days, with no successful contact from the Client during that time, may be considered abandoned, and Elegance Upholstery reserves the right to dispose of or resell the item to recover costs. Items will not be considered abandoned if the Client maintains regular communication and makes arrangements with the shop.

7. Chargebacks, Disputes, and Liability
7.1. Chargebacks initiated for services rendered will be contested with supporting documentation including signed agreements, photographs, and written communication.
7.2. Elegance Upholstery is not liable for:

Natural wear and tear or fading post-service

Pre-existing damage or structural issues

Customer dissatisfaction due to uncommunicated preferences
7.3. The Client agrees that communication is their responsibility and acknowledges that they have reviewed, understood, and accepted these terms.
7.4. Pricing and policies are subject to change without notice. The Client agrees to the pricing and payment terms as outlined in their approved estimate or invoice at the time of deposit. Elegance Upholstery will not honor retroactive pricing disputes based on newer or older rates, promotions, or changes in policy.
7.5. Any changes to the scope of work, materials, or design features after the initial estimate may result in additional charges. These changes do not require an updated written estimate from Elegance Upholstery unless specifically requested by the Client. It is the Client’s responsibility to request an updated quote if they wish to know how changes will affect pricing. Verbal instructions, additional tasks, or design changes made after the original estimate will not be performed free of charge unless expressly agreed in writing.
7.5.1. Clients acknowledge that labor charges are fixed based on the original quote unless additional work is requested or required. However, material prices may fluctuate, and fabric yardage estimates are subject to change. The original estimate does not constitute a final price guarantee, and final charges may vary. Elegance Upholstery guarantees that labor costs will not exceed the quoted amount unless the scope of work changes and is approved by the Client.
7.6. Clients are responsible for documenting the condition of their piece upon delivery to our shop. If damage is discovered or claimed after intake, the Client must provide time-stamped photos clearly showing the area in question at the time of arrival to support their claim. Elegance Upholstery is not responsible for proving the absence of damage, and no repairs will be made unless such evidence is provided. If sufficient documentation is presented, Elegance Upholstery will provide appropriate repairs at no additional cost.

8. Liability & Client Responsibility
8.1. Elegance Upholstery shall not be held liable for any personal injuries, property damage, or incidental harm incurred by the Client or any third party resulting from the handling, transport, or use of the reupholstered item after it has been released from our care.
8.2. It is the Client’s responsibility to ensure that adequate care is taken during pickup, loading, unloading, and placement of the item. Clients are encouraged to bring help and appropriate transport materials.
8.3. Elegance Upholstery makes every effort to ensure that all items are safe for ordinary use at the time of completion. However, we are not liable for injuries or damages resulting from misuse, neglect, improper installation, structural failure due to age or material fatigue, or use outside of normal conditions.
8.4. By signing this agreement, the Client assumes full responsibility for the item once it leaves the premises and waives all claims against Elegance Upholstery relating to post-delivery handling or usage.
8.5. The Client agrees to indemnify and hold harmless Elegance Upholstery from any claims, damages, or expenses (including legal fees) arising from the Client’s negligence or misuse of the reupholstered item.

9. Scheduling, Deadlines, & Governing Law
9.1. If the Client requires the project to be completed by a specific deadline, it is their responsibility to indicate this before work begins. Elegance Upholstery is not obligated to meet deadlines that are imposed after the agreement is signed and the project has begun.
9.2. While Elegance Upholstery will make every effort to accommodate the Client’s requested timeline in good faith, any agreement to attempt to meet a deadline does not constitute a guarantee.
9.3. All deadlines are subject to additional rush fees, which will be clearly communicated in advance. If the Client rejects the proposed rush fee, they agree that the project may not be completed by the requested date.
9.4. Regardless of deadlines, Elegance Upholstery always works to complete projects as efficiently as possible without compromising quality.
9.5. Estimated completion dates are approximate and not guaranteed. Elegance Upholstery is not liable for delays caused by events beyond our control, including material shortages, supplier delays, weather, or other force majeure circumstances.
9.6. This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta. Disputes arising from this Agreement shall be resolved through binding arbitration in Lethbridge, Alberta, unless both parties agree otherwise in writing.
